Nature of the Coaching Services

Scope of Services: Maipha provides personalised coaching and consulting services tailored to parents and caregivers of children with learning disabilities and/or mental health challenges. Our services include:

  • One-on-one coaching sessions designed to address specific parenting and personal goals.

  • Group workshops and webinars that foster collective learning and peer support.

  • Digital resources, including e-books, mini-courses, and templates, accessible via the Digital Resource Hub.

  • A supportive Community Forum that encourages connection and knowledge-sharing among parents navigating similar challenges. The goal is to empower parents with tools, strategies, and emotional support to nurture their child’s growth while prioritizing their own well-being.

  1. Non-Medical Services: The services provided by Maipha are strictly non-medical and intended for educational and informational purposes only. Our coaching and resources aim to complement, not replace, professional medical, psychological, or psychiatric advice, diagnosis, or treatment. Clients should view these services as supplementary support to their existing healthcare and educational plans.

  2. Limitations of Services:

    • Maipha does not provide emergency services, clinical psychological treatment, or other forms of medical intervention.

    • Clients experiencing urgent or severe health-related concerns should seek professional assistance from licensed healthcare providers or emergency services.

    • Our role is to guide and support, but clients are encouraged to involve appropriate professionals for their child’s medical or psychological needs.

  3. Client Responsibility:

    • The effectiveness of coaching depends on the client’s active participation, honesty, and willingness to apply insights and strategies shared during sessions.

    • Clients are responsible for taking the necessary steps to implement the practices discussed and shared during coaching. While Maipha provides guidance, the ultimate responsibility for personal growth and change rests with the client.

  4. Confidentiality:

    • All interactions between Maipha and clients, including the content of coaching sessions, personal information, and shared data, are handled with the utmost confidentiality as outlined in our Privacy Policy.

    • Confidentiality applies to all forms of communication. Exceptions include situations where disclosure is required by law or when there is an imminent risk to the client’s or another individual’s safety.

Payment Terms

  1. Payment Options: Maipha offers flexible payment plans to ensure accessibility to our coaching services:

  • Full Payment in Advance: Clients may choose to pay the full program cost upfront. This secures their spot and covers all sessions included in the program. Clients booking at least 30 days in advance can benefit from our Early Bird Discount, receiving a 10% reduction in the total cost.

  • Installment Plan: Clients may opt for a three-installment payment plan:

    • The first installment is required at the time of booking to confirm the spot.

    • The remaining two installments are due in equal intervals over the following two months.

    • The Early Bird Discount does not apply to the installment plan.

  1. Payment Processing: All payments are securely processed via trusted platforms, including Stripe and PayPal. Clients can pay using major credit or debit cards, as well as PayPal accounts. Maipha adheres to the highest standards of security, ensuring all payment information is encrypted and protected.

  2. Refund Policy: We are committed to client satisfaction and aim to provide high-quality coaching services. Refund requests are subject to the following conditions:

    • Full Refund: Available for cancellations made at least 14 days before the program start date.

    • Partial Refund: A 50% refund will be issued for cancellations made between 14 and 7 days before the program begins.

    • No Refunds: Cancellations made less than 7 days before the program starts or after the program has commenced are not eligible for refunds.

  3. Late Payments:

    • For installment plans, payments not received within 7 days of the due date will incur a late fee of 5% of the overdue amount.

    • Failure to make payments may result in the suspension of coaching services until the outstanding balance is settled.

  4. Cancellation by Client: Clients may cancel their participation in the coaching program under the refund policy outlined above. We request clients to notify us of cancellations as early as possible to ensure smooth scheduling and accommodate others waiting to enroll.

  5. Cancellation by Maipha: In the rare event that Maipha needs to cancel a scheduled session or program:

    • Clients will be notified promptly.

    • Clients will have the option to receive a full refund or reschedule for an alternative session at their convenience.

Intellectual Property

  1. Ownership of Materials: All materials provided during coaching sessions, including but not limited to worksheets, digital resources, guides, videos, handouts, and any other content (collectively, "Coaching Materials"), are the sole and exclusive property of Maipha. These materials are protected by copyright and other intellectual property laws. They are licensed to clients solely in connection with the coaching services purchased.

  1. License to Use: Clients are granted a non-exclusive, non-transferable, revocable license to use the Coaching Materials strictly for personal and non-commercial purposes. This license is specific to the client and does not permit:

    • Sharing materials with individuals who are not participants in the coaching services.

    • Reusing the materials for commercial purposes or personal gain.

    • Modifying, replicating, or distributing the materials without prior written consent from Maipha.

  2. Restrictions on Use: To protect Maipha’s intellectual property and ensure fair use:

    • Clients may not copy, distribute, or share Coaching Materials with third parties not enrolled in the coaching program.

    • Clients are prohibited from using Coaching Materials in ways that compete with Maipha’s business, including creating similar coaching or educational content based on the materials.

    • Clients may not modify, sell, or create derivative works from the Coaching Materials without express written permission from Maipha.

  3. Copyright Notice: Coaching Materials provided by Maipha, either created in-house or used with permission, are protected by copyright and other applicable laws. Clients must not remove, obscure, or alter any copyright, trademark, or other proprietary notices contained within the materials.

  4. Consequences of Unauthorized Use: Any unauthorized use of Maipha’s Coaching Materials immediately terminates the license granted to the client. In such cases:

    • Maipha reserves the right to demand the return or destruction of any improperly used materials.

    • Legal action may be pursued to address infringement of intellectual property rights, as deemed necessary.

No Guarantees on Outcomes: Maipha provides professional coaching services designed to support, educate, and guide parents and caregivers of children with learning disabilities and/or mental health challenges. Therefore, we cannot guarantee specific results or outcomes from our services.

Clients are expected to actively engage in sessions and implement the insights and techniques provided.   2. Variability of Results: Coaching results can vary significantly from one client to another due to differences in personal situations, external factors, and individual actions. Maipha does not promise that our services will directly resolve specific issues or yield identical outcomes for all clients. Each journey is unique, and success depends on a range of variables.

Limitation of Liability: To the fullest extent permitted by law, Maipha is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from the client’s use of or reliance on our coaching services. This limitation of liability applies regardless of the nature of the claim, including those based on contract, tort, negligence, strict liability, or other legal grounds, even if Maipha has been informed of the possibility of such damages.

  4. Acknowledgement of Risk: By engaging in our coaching services, clients acknowledge that they assume full responsibility for their decisions, actions, and any resulting outcomes. Maipha and its coaches are not legally liable for the consequences of client actions undertaken based on the guidance provided during coaching sessions. Clients agree to use Maipha’s services at their own discretion and risk.

Confidentiality Clause

    Maipha is dedicated to maintaining the highest level of confidentiality in all client interactions. We recognise the sensitive nature of the personal information shared during coaching sessions and are committed to protecting your privacy and ensuring the secure handling of your data.

    All discussions, documentation, and information shared during the coaching relationship between Maipha and the client will remain strictly confidential. This includes, but is not limited to, personal details, session notes, and communication records. Information will not be disclosed to any third party without the explicit, written consent of the client, except in circumstances required by law.

  2. Exceptions to Confidentiality:
    Confidentiality is upheld in all situations, except in the following scenarios where disclosure is legally mandated or ethically necessary:

    • Legal Obligations: If compelled by law (e.g., court orders or legal proceedings), Maipha may be required to disclose confidential information.

    • Safety Concerns: If there is an imminent risk to the client’s safety or the safety of others, Maipha is obligated to notify the appropriate authorities.

    • Abuse or Neglect: In cases where evidence of abuse or neglect involving children, vulnerable adults, or the elderly is identified, Maipha is legally required to report this to relevant authorities.

  3. Protection of Confidential Information:
    Maipha utilises robust administrative, technical, and physical measures to safeguard the confidentiality of your information. We follow best practices to prevent unauthorised access, misuse, or disclosure of your data.

  4. Client Responsibilities:

    With the client’s explicit permission, anonymised and non-identifiable information may be used for professional development purposes, such as case studies, training, or educational materials. Personal details will never be disclosed in these contexts.

Use of Testimonials

    All testimonials featured on our website reflect genuine experiences shared by real clients of Maipha. Before publishing, we obtain explicit consent from each client, which includes their agreement to share their statements, names, images, or videos (if applicable). Testimonials are provided voluntarily and are intended to showcase personal experiences with our coaching services.

    Testimonials highlight individual client experiences and are not guarantees of universal outcomes. Each client’s journey is unique, with results influenced by factors such as personal dedication, circumstances, and the application of learned strategies.   4. Client Rights and Updates
    Clients who provide testimonials have the right to request updates, revisions, or complete removal of their testimonials at any time. If a testimonial no longer aligns with the client’s perspective or they wish to withdraw it for any reason, we will honour their request promptly.

Cancellation and Rescheduling Policy

  1. Notice Period
    Clients must provide a minimum notice of 24 hours to cancel or reschedule a scheduled coaching session. This allows us to manage our schedule efficiently and offer the slot to other clients who may be waiting for an appointment.

  2. Cancellation Fees

    • Cancellations made more than 24 hours before the session: No fees will be incurred. Clients may reschedule their appointment or request a refund if applicable.

    • Cancellations made less than 24 hours before the session: A cancellation fee of 50% of the session cost will be charged to compensate for the short notice and the inability to fill the vacated slot.

    • No-shows or failure to notify: The full session fee will be charged. Exceptions may be made in cases of genuine emergencies, with appropriate verification.

  3. Rescheduling Sessions

    • Sessions can be rescheduled without additional cost if done at least 24 hours in advance.

    • Rescheduling requests made with less than 24 hours' notice may incur the same fees as cancellations.

  4. Process for Cancellation or Rescheduling
    To cancel or reschedule a session, please contact us directly via email or phone as listed on our contact page. Providing as much notice as possible is greatly appreciated.

  5. Exceptions
    Maipha reserves the right to cancel or reschedule sessions if necessary. In such cases, clients will be notified promptly, and no fees will be charged. Clients will also be offered the next available slots to reschedule their session at their convenience.

    While our services focus on adults, they may indirectly involve information about minors, especially when parents seek guidance on supporting their children. Parents and legal guardians are responsible for maintaining the privacy and safety of their child's information. Maipha is committed to handling any minor-related information with utmost care, ensuring compliance with all applicable laws regarding the protection of children's data.

  3. Parental Consent
    Parents or guardians seeking coaching related to their child’s condition must share the minor’s personal information judiciously, limiting disclosures to what is necessary for effective coaching. Maipha does not directly collect or solicit personal information from minors.

  4. Compliance with Child Protection Laws
    Maipha adheres to all laws and regulations governing the protection of children’s information. If actionable information regarding the health or safety of a minor arises during sessions, Maipha will act in accordance with legal obligations, including reporting to the appropriate authorities as required.
