Nature of the Coaching Services

1. Scope of Services: Maipha provides personalised coaching services designed to support mothers and families of children with learning disabilities and/or mental health issues. Our services include, but are not limited to, one-on-one coaching sessions, group workshops, digital resources, and community support forums. The content and advice given are tailored to assist clients in enhancing their parenting skills, understanding their child’s needs, and managing personal well-being.

2. Non-Medical Services: It is important for all clients to understand that the coaching services provided by Maipha are strictly non-medical. While we aim to offer valuable support and guidance, our services do not replace professional medical, psychological, or psychiatric advice, diagnosis, or treatment. Our coaching sessions are intended for educational and informational purposes only and should be seen as a supplement to, not a substitute for, professional healthcare.

3. Limitation of Services: Clients are advised to seek professional medical advice if their situation involves urgent or severe mental health issues, medical conditions, or other health-related concerns. Maipha and its coaches do not provide emergency services, clinical psychological services, or any other type of professional medical intervention. Clients are responsible for obtaining comprehensive healthcare services from licensed healthcare providers.

4. Client Responsibility: The effectiveness of coaching greatly depends on the client’s commitment to actively participate in the process. Clients are encouraged to be open, honest, and engaged during sessions. However, the ultimate responsibility for personal growth and change resides with the client. Our role is to facilitate self-awareness and provide tools and strategies to support the client’s goals.

5. Confidentiality: All interactions between the client and our coaches, including the content of sessions, client data, and personal information, are held in strict confidence as per our Privacy Policy. Confidentiality extends to all forms of communication, both direct and indirect. Exceptions to confidentiality include disclosure required by law and situations where there is an imminent risk to health or safety.

Payment Terms

1. Payment Options: Maipha offers two convenient payment plans for our coaching services:

  • Full Payment in Advance: Clients may opt to pay the full amount for the coaching program upfront. This payment secures their spot and covers all sessions included in the program. Clients who take advantage of our Early Bird Discount will receive a 10% reduction in the total cost if they book and pay in full at least 30 days before the program begins.

  • Instalment Plan: As an alternative, clients may choose to pay in three instalments. The first instalment is due at the time of booking to secure the client’s place in the program. The remaining two instalments will be due at equal intervals over the next two months. The Early Bird Discount does not apply to the instalment plan.

2. Payment Processing: All payments are processed securely through our online payment partners, Stripe and PayPal. Clients can make payments using major credit cards, debit cards, or their PayPal account. All payment information is encrypted and handled according to the highest standards of security and compliance.

3. Refund Policy: We strive to offer high-quality coaching services tailored to the needs of our clients. However, if a client is dissatisfied with our services, they may request a refund under the following conditions:

  • A full refund will be provided if the cancellation occurs at least 14 days before the start of the program.

  • A 50% refund will be provided for cancellations made less than 14 days but more than 7 days before the program begins.

  • No refunds will be given for cancellations made less than 7 days before the program starts or after the program has commenced.

4. Late Payments: For clients on the instalment payment plan, if a scheduled payment is not received within 7 days of the due date, a late fee of 5% of the overdue amount may be applied. Continued non-payment may result in suspension of the coaching services until the due balance is cleared.

5. Cancellation by Client: Clients can cancel their enrolment in our coaching program as per the conditions outlined in our refund policy. We request that clients notify us of cancellations as early as possible to accommodate others who may be waiting for an opportunity to enrol.

6. Cancellation by Maipha: In the rare event that Maipha must cancel a scheduled coaching session or program, clients will be notified immediately, and a full refund will be issued or an alternative session will be scheduled at the client’s convenience, depending on the client’s preference.

Intellectual Property

1. Ownership of Materials: All materials provided during coaching sessions, including but not limited to worksheets, digital content, guides, videos, and handouts (collectively, "Coaching Materials"), are the exclusive property of Maipha. These materials are provided to clients under a license linked to the coaching service purchased and are protected by copyright and other intellectual property laws.

2. License to Use: Maipha grants clients a non-exclusive, non-transferable, revocable license to use the Coaching Materials solely for personal, non-commercial purposes. This license is limited to the client’s personal use, which means clients may not distribute, modify, transmit, reuse, download, repost, copy, or use the said materials, in whole or in part, for commercial purposes or for personal gain, without express written permission from Maipha.

3. Restrictions on Use: Clients are prohibited from:

  • Copying, distributing, or sharing the Coaching Materials with third parties not involved in the personal coaching sessions unless explicitly authorised by Maipha.

  • Using the Coaching Materials in any manner that could compete with the business of Maipha, including offering similar coaching or educational content based on the materials provided.

  • Modifying, selling, or creating derivative works based on the Coaching Materials.

4. Copyright Notice: All Coaching Materials are either the property of Maipha or are used with appropriate permissions. Copyright notices, trademarks, and other proprietary rights notices contained within or on the materials must not be removed, obscured, or altered.

5. Consequences of Unauthorised Use: Any unauthorised use of the Coaching Materials terminates the license granted by Maipha. Maipha reserves the right to demand immediate return or destruction of any materials that are used in violation of these terms. Further legal action may be taken for infringement of intellectual property rights, where necessary.

Disclaimer of Guarantees

1. No Guarantees on Outcomes: Maipha provides professional coaching services intended to support, educate, and guide mothers and families dealing with learning disabilities and/or mental health issues in their children. While we strive to offer high-quality, effective support and guidance, it is important for all clients to understand that the outcomes of any coaching process depend heavily on various personal factors that are outside of Maipha's control. As such, Maipha cannot guarantee specific results or outcomes from our coaching services.

2. Client Responsibility: The success of coaching is largely dependent on the client’s commitment, effort, and the application of learned strategies. Clients are responsible for integrating and implementing the techniques and insights gained from the coaching sessions into their daily lives. The client’s personal situation, background, dedication, and cooperation are crucial elements that will affect the ultimate outcome of the coaching process.

3. Variability of Results: Results from coaching services can vary widely among clients due to differences in individual motivations, actions, and external factors. Each client's situation is unique, and thus, the effectiveness of the coaching services will vary. Maipha cannot promise that the use of our services will directly solve specific problems or result in any particular outcomes.

4. Limitation of Liability: To the maximum extent permitted by law, Maipha shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of the client’s access to, use of, or reliance on the coaching services provided. This limitation of liability applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Maipha has been advised of the possibility of such damage.

5. Acknowledgement: By agreeing to engage in our coaching services, clients acknowledge that they do not hold Maipha or any of its coaches legally liable for the actions they undertake or the results thereof, based on the guidance provided. Clients also agree that they are using Maipha’s services at their own risk.

Limitation of Liability: Maipha is not responsible for any personal decisions or actions taken by clients as a result of our coaching. We provide guidance and support based on our professional expertise, but all decisions made and actions taken are the sole responsibility of the client. We do not accept liability for any harm or loss which may arise from reliance on the content of our coaching or any assumptions that may be drawn from it.

Confidentiality Clause

Commitment to Privacy: Maipha is committed to maintaining the highest degree of confidentiality in the services provided to our clients. We understand the sensitive nature of the personal information shared during coaching sessions and are dedicated to safeguarding your privacy.

Scope of Confidentiality: All conversations, documentation, and information shared during the course of the coaching relationship between the client and Maipha will be treated as confidential. This includes but is not limited to personal data, session notes, and any communications related to the coaching process. No such information will be disclosed to a third party without the explicit consent of the client, except as required under applicable law.

Exceptions to Confidentiality: Confidentiality extends to all records and communications, but the following exceptions apply where Maipha is legally obligated to disclose information:

  • Legal Requirements: If required by law, such as in the case of a court order or other legal proceedings, Maipha may be compelled to release confidential information.

  • Threats to Safety: If there is a threat to the client’s safety or the safety of others, Maipha is required to take necessary steps to prevent harm, which may include disclosing information to the appropriate authorities.

  • Abuse or Neglect: If there are signs of abuse or neglect towards children, the elderly, or vulnerable adults, Maipha may be required to report this to the relevant authorities as mandated by law.

Protection of Confidential Information: Maipha employs appropriate administrative, technical, and physical measures to protect the confidentiality of your information and to ensure that it is not accessed or disclosed unlawfully.

Client's Responsibilities: While Maipha upholds confidentiality, clients are also responsible for maintaining the privacy of their coaching sessions. This includes securing any communications, documents, or materials related to their sessions.

Consent to Use of Information for Professional Development: With the client's permission, non-identifiable information may be used for professional case studies or training purposes, ensuring that all specific personal details remain confidential.

Cancellation and Rescheduling Policy

Notice Period: Clients are required to provide a minimum notice of 24 hours if they need to cancel or reschedule a scheduled coaching session. This allows us to manage our schedule and offer the slot to other clients who may be waiting for an appointment.

Cancellation Fees:

  • Cancellations made more than 24 hours before the scheduled session time will not incur any fees. Clients can choose to reschedule their appointment to a more convenient time or request a refund if applicable.

  • Cancellations made less than 24 hours before the scheduled session will be subject to a cancellation fee of 50% of the session cost. This fee compensates for the short notice and the potential inability to fill the vacated slot on short notice.

  • No-shows or failures to notify us of cancellation will result in a charge of the full session fee. We understand emergencies can occur and will be considerate in cases of genuine emergency with appropriate verification.

Rescheduling Sessions: Clients may reschedule their session without any additional cost if done so at least 24 hours before the scheduled time. If a session is rescheduled with less notice, the client may be subject to the same fees as canceling a session.

Process for Cancellation or Rescheduling: To cancel or reschedule a session, please contact us directly via email or phone as provided on our contact page. We appreciate as much notice as possible to help accommodate other clients.

Indirect Involvement of Minors: While our services are aimed at adults, we recognise that the topics discussed may indirectly involve information about minors, particularly in contexts where parents are seeking guidance on how to better support their children. In these cases, it is the responsibility of the parent or legal guardian to maintain the privacy and safety of their child's information. Maipha commits to handling any information related to minors with the utmost care and in compliance with applicable laws regarding the protection of children's data.

Parental Consent: Parents or legal guardians seeking coaching regarding their child's condition must ensure that any sharing of the minor's personal information during sessions is done so with discretion and only as necessary to facilitate the coaching process. Maipha does not directly solicit personal information from minors.

Compliance with Child Protection Laws: Maipha complies with all applicable laws and regulations concerning the protection of children’s information. Should any actionable information concerning the health or safety of a minor come to light during our coaching sessions, it will be handled in accordance with legal obligations and ethical considerations to report such issues to appropriate authorities.
